Waver Form Before the Headphones Go On

(aka: How We All Have a Good Time and Nobody Cries Later)

1. The Deal (Hire Agreement)

By hiring silent disco headsets from Byron Bay Silent Disco, you’re agreeing to these terms. Nothing scary here — just a mutual understanding that we trust you, and you don’t treat our gear like a football.

2. Bring Them Back Alive (Return of Headsets)

All headsets must be returned in the same condition you received them.
That means:

  • Not smashed

  • Not drowned

  • Not “accidentally taken home”

  • Not mysteriously vanished into the night

If they come back damaged, altered, or missing, extra charges may apply (see below).

3. If You Break It, You Buy It (Liability for Damage)

You’re responsible for looking after the gear.
If a headset is:

  • Lost

  • Broken

  • Thrown into the ocean

  • Used as a pillow, weapon, or flotation device

…then a $100 replacement fee per headset applies.
Yes, even if it was “just an accident”.

4. Use Them Like a Normal Human (Usage Restrictions)

The headsets are for listening to music and dancing.
They are not for:

  • Modifying

  • Taking apart

  • Testing your engineering skills

  • Extreme sports

Any misuse may result in damage fees. Please don’t get creative.

5. Money Stuff (Payment & Security Deposit)

Full payment is required before the event.
In some cases, we may ask for a security deposit — don’t worry, you’ll get it back once everything is returned safely and passes the “yep, looks good” inspection.

6. Timing Matters (Collection & Return)

Please collect and return the headsets at the agreed times.
Late returns may incur extra fees, and nobody enjoys awkward follow-up messages.

Event Participation Waiver
(Yes, this part is serious — but we’ll keep it readable)

A. You Know What You’re Signing Up For (Assumption of Risk)

Silent discos are fun, but life happens.
By attending, you acknowledge that risks exist, including (but not limited to):

  • Slips

  • Falls

  • Injuries

  • Ocean-related bad ideas

  • Very poor dance decisions

You attend voluntarily and accept responsibility for your own safety.

B. If Something Happens, Don’t Sue the DJ (Liability Release)

Byron Bay Silent Disco — including owners, staff, contractors, and affiliates — is not liable for injuries, accidents, or damages during the event.

You agree not to pursue legal action and to hold us harmless from any claims arising from participation.

C. Under 18? Bring a Responsible Adult (Parental Agreement)

If you’re under 18, a parent or legal guardian must agree on your behalf and accept responsibility.
No loopholes. No “but my mum said it’s fine” after the fact.

D. We’re Reasonable People (No Negligence Clause)

This waiver does not protect Byron Bay Silent Disco from:

  • Gross negligence

  • Reckless behaviour

  • Intentional harm

You are, however, responsible for your own actions and decisions.

E. Aussie Rules Apply (Governing Law)

These terms fall under the laws of New South Wales, Australia.
Any disputes will be handled in NSW courts — hopefully never.

F. Photos, Videos & Social Media Content

We may take photos and videos during the event for promotional and marketing purposes.
By hiring equipment and/or participating in a Byron Bay Silent Disco event, you:

Consent to being photographed and/or filmed while using the silent disco equipment

Grant Byron Bay Silent Disco permission to use this content for: Social media,Website, Advertising, Promotional materials

We agree that:
Content will be used respectfully

Content will not be intentionally offensive, defamatory, or misleading
If you have concerns about being filmed, please notify our staff before the event begins.

Extra Safety Rules (Because Common Sense Isn’t Always Common)

  • Use designated beach access paths — no climbing down rocks like a mountain goat.

  • Swimming is strictly prohibited during the event.

    • No lifeguards

    • No supervision

    • The ocean does not care how confident you feel

  • You’re responsible for your own safety and wellbeing at all times.

Personal Belongings

We are not responsible for lost, stolen, or damaged personal items.
If you bring it, look after it.

Final Agreement (The Nod of Approval)

By hiring equipment and/or attending a Byron Bay Silent Disco event, you confirm that:

  • You’ve read this

  • You understand it

  • You agree to it

  • You won’t pretend you didn’t later
